ILLINOIS COURT OF APPEALS AFFIRMS COURT’S SUMMARY JUDGMENT DECISION IN CROSSING CASE

The Illinois Court of Appeals affirmed a Summary Judgment decision on behalf of a long-standing railroad client. The crossing case was originally tried downstate in 2009 and resulted in a defense verdict in favor of MGS’ client. The plaintiffs did not appeal, but instead, they filed a lawsuit in Cook County, alleging spoliation. MGS’ Ray Groble filed a summary judgment motion premised on res judicata and collateral estoppel. The court granted our client’s motion, and the plaintiffs appealed. Ultimately, the Illinois Court of Appeals affirmed the circuit court’s summary judgment in favor of our client.
