MGS’ Dan Mohan and Sean Gingrich won a cumulative trauma jury trial for a long-standing railroad client. The plaintiff claimed that as a result of walking on mainline ballast in the yard over a period of 7 years he developed bilateral neuromas of the feet, requiring surgery.

At the end of a week-long trial, Plaintiff’s attorney requested a verdict of $167,200, but the jury came back with a verdict of not guilty in favor of our client. Speaking with the jury afterwards, the jurors indicated that they were very impressed with the safety culture of our client and did not know how our client could have been any safer. One juror even asked if our client was hiring, as it seemed like a great place to work.
