Bob Prendergast obtained a summary judgment victory on liability for indemnity against a railroad client’s contractor who had refused to assume the defense or indemnify the railroad in a personal injury action as required by the contract.
When the contractor’s insurance company filed a declaratory judgment action arguing that the railroad was not an insured under the general liability policy, Bob also obtained a ruling that the contractor was required to indemnify the railroad for its fees and costs incurred in the declaratory judgment action.
