SEVENTH CIRCUIT AFFIRMS SUMMARY JUDGMENT IN PROPERTY DAMAGE CASE

The Seventh Circuit affirmed a summary judgment for an energy client in a property damage case arising out of the collapse of a hydro power canal in Marseilles, Illinois in April 2000. The plaintiff alleged the collapse was caused in part by installation of various electric distribution facilities between the 1960’s and 1994. Federal District Judge Harry D. Leinenweber granted Sean Sullivan‘s motion for summary judgment on the grounds that plaintiff’s claims were barred by the statute of limitations, and the Seventh Circuit affirmed in an opinion by Judge Wood.
